Biden Regime Admits It’s Violating The Law By Paroling Refugees

In a stunning, though likely inadvertent, admission, the Biden Regime has admitted that it is acting illegally by using their Parole Amnesty to bring refugees into the United States. Much of the Biden Regime Parole Amnesty has been nothing more than using parole to bring aliens whom the Biden Regime wants to classify as refugees, but who do not meet the definition of refugees.

A refugee is a specific legal category of aliens allowed to come to the United States and live. Their admission is based on being persecuted by their country of nationality.

From the statutory definition of a refugee:

…any person who is outside any country of such person’s nationality or, in the case of a person having no nationality, is outside any country in which such person last habitually resided, and who is unable or unwilling to return to, and is unable or unwilling to avail himself or herself of the protection of, that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion…

The legal standard for refugee is very high and most aliens who claim to be refugees are not, such as Ukrainians dodging the draft, but the Biden Regime, in its White Replacement campaign, decided that it wanted to define as refugees as many non-white aliens as it could in order to justify bringing those aliens to the United States. The problem was that so few aliens qualified, and even if there was an unlimited number of refugee slots to be filled, it could not find as many as it wants. The Biden Regime is even having trouble finding enough refugees to meet their cap of 125,000 slots for the year [Inside The Lawless Biden Regime Administrative Amnesty, Federale Blog, January 31, 2022].

Since taking office, the Biden administration has sought to rebuild the resettlement infrastructure. In fiscal year 2022, U.S. refugee admissions increased to 25,465, though that represented only 20% of the 125,000 available spots. In fiscal year 2023, which ends on Friday at midnight, the U.S. is on track to resettle more than 60,000 refugees, according to the internal federal data, the highest level since the end of the Obama administration. It would also be less than half of the 125,000-spot ceiling.

Since the demand for legally defined refugees is higher than the supply, the Biden Regime, and the Obama Regime before it, were bringing in fraudulent refugee claimants as parolees, beginning with the Central American Minors (CAM) program, which specified if aliens outside the United States had a denied refugee application, they would then be paroled into the United States [Biden Regime Amnesty For Illegal Alien Children Opening Up Floodgates, Federale Blog, September 14, 2021].

The problem with paroling failed refugee applicants is that it is illegal.

(B) The Attorney General may not parole into the United States an alien who is a refugee unless the Attorney General determines that compelling reasons in the public interest with respect to that particular alien require that the alien be paroled into the United States rather than be admitted as a refugee under section 1157 of this title.

However, the Biden Regime has decided it is not bound by the law. In a recent announcement expanding the Biden Regime Parole Amnesty, U.S. Citizenship and Immigration Services (USCIS) stated that it is paroling in refugees.

U.S. Citizenship and Immigration Services (USCIS) is updating policy guidance in the USCIS Policy Manual regarding maximum validity periods for Employment Authorization Documents (EADs, Form I-766) issued to refugees and asylees, noncitizens [sic: aliens] paroled as refugees, noncitizens granted withholding of removal, noncitizens with pending applications for asylum or withholding of removal, noncitizens with pending applications for adjustment of status under INA 245, and noncitizens seeking suspension of deportation or cancellation of removal.

The Biden Regime openly admitted in a policy letter than it is violating red-letter law. How much more evidence does one need to see the lawlessness of the Biden Regime immigration policies?
