Well, given the Obama Regime Administrative Amnesty, it is a surprise he was arrested, but at least even John Morton, head of U.S. Immigration and Customs Enforcement, does say that those with outstanding deportation orders are a priority.
But truly, Kong Xin Chen doesn’t know there was an outstanding deportation order? He lived here for 18 years with no documents and never bothered to contact his attorney about his status?

Kerry, Keating Step Into Deportation Case
US Senator John Kerry and US Representative William Keating have joined the effort to keep a popular Marshfield restaurant owner from being deported to China, which he left almost 20 years ago to escape poverty and make a new life.
The politicians join hundreds of area residents who say 38-year-old Kong Xin Chen, who is being held by federal authorities, should be allowed to go home to his wife and two small children. Chen was arrested at his Mandarin Tokyo restaurant almost three months ago on an 18-year-old deportation order that his lawyer said Chen didn’t know existed, and is being held in the Etowah County Detention Center in Gadsden, Ala …
Chen came to the United States in 1993 as a teenager from China’s Fujian province and applied for political asylum in New York, Goldstein said.
Because of miscommunication with his attorney then, Chen missed a court appearance in 1994 and was unaware that the judge issued a deportation order, Goldstein said.
Just from the minimal amount of information in the story about Chen, once can deduce what happened. He came from Fujian Province and filed a false asylum claim. This was quite common in the 90s when Chinese alien smugglers were so brazen they hired ocean going vessels to bring boatloads of aliens to the United States.
Almost all were organized by the infamous smuggler Cheng Chui Ping, known as Big Sister Ping, who no resides in the Big House. After bringing the aliens to the U.S., she would file initial asylum applications, which entitled the alien to employment authorization, and consequently Social Security Cards and the panoply of other documents, like State driver’s licenses, that followed.
With those documents, the aliens would disappear, as the fraudulent nature of their asylum applications were plain for all to see. It was a farce, but protected by both RINOS and Democrats. The RINOs because the Chinese immigrants, both male and female, claimed asylum based on China’s one child policy and their solution was to flood America with Demoncrat voters. What rocket scientists. The Democrats because local pols were in with the local Chinese community and Bill Clinton was being paid off by big money donors from Red China; Charlie Trie, Johnny Chung, John Huang, Maria Tsia, et. al.
Of course Chen was not in on the big story, he was just a teenager, and destined for slave labor in NYC’s Chinese community where most of the Fukinese involved in Big Sister Ping’s scheme ended up. He was a little more fortunate. Or he worked hard enough to pay off the massive debt that participants were burdened with. They indentured themselves to Big Sister Ping and her Triad associates to the tune of tens of thousands of dollars. Few would escape a life of such indentured servitude because most of their wages went to the interest and expenses charged to the unfortunates by the gangsters.
Chen appears to be a fortunate one. He got out of the downward debt spiral or somehow escaped. Maybe that was why he was living on the down low. But it not credible that he lived in the United States since 1993 and never realized that he had an immigration problem. His employment authorization expired long ago. His wife apparently naturalized during this period. What did she report on her Form N-400, Application for Naturalization, about her husband? Did she report that he was illegal? An asylum applicant? Check out questions E 1-3. She had to report something. Perhaps she lied and should now be denaturalized and deported as well. Clearly he knew what was happening and was living below the radar, hoping to get by. Perhaps hoping to benefit from the endlessly proposed and endlessly defeated legislative amnesty proposals.
But entered illegally, he lied on his asylum application, and he should be deported. He knew what he was doing and should suffer the consequences.
