The New York Times is worrying in its print edition this morning that voters in several different states might actually exercise their right to vote out judges! Voters Moving to Oust Judges Over Decisions, by A.G. Sulzberger, September 24, 2010.
Around the country, judicial elections that were designed to be as apolitical as possible are suddenly as contentious as any another race.
Of course, the reason for this is that judges are also supposed to be "apolitical". But they have been increasingly legislating liberal dogma from the bench.
Federal judges, of course, cannot be voted out — but they can be impeached by legislators.
The current races are mostly triggered by judge-imposed gay marriage, but I predicted in Alien Nation that
When Americans do seize control of their immigration policy again, it will inevitably take the form of an epic clash between the legislative and judicial branches.
And, as I’ve pointed out before, impeachment is the check/ balance that the constitution has provided against abusive judges and elected officials.
