ICE Closing Detention Centers, Ending Detention Of Illegal Aliens Despite Statutory Requirement To Detain Them

The Biden Regime Administrative Amnesty continues unabated, despite the statutory requirement that many classes of illegal aliens must be detained until their case is adjudicated.

In this example of the Administrative Amnesty, the black head of ICE SVU ( U.S. Immigration and Customs Enforcement), Tae Johnson, just decided to start closing ICE detention centers in a wholesale manner.

Four major provisions of the Immigration and Nationality Act, as amended, provide that certain classes of illegal aliens shall be detained:

INA § 236(a) generally authorizes the detention of aliens pending a decision on whether the alien is to be removed from the United States and permits those who are not subject to mandatory detention to be released on bond or their own recognizance;

INA § 236(c) generally requires the detention of aliens who are removable because of specified criminal activity or terrorism-related grounds;

INA § 235(b) generally requires the detention of applicants for admission who appear subject to removal, including aliens arriving at a port of entry and certain other aliens who have not been admitted or paroled into the United States; and

INA § 241(a) generally requires an alien subject to a final order of removal to be held during the 90-day period when the alien’s removal is effectuated, and DHS may detain an alien beyond this 90-day period if the agency is unable to effectuate removal and the alien falls within certain categories.

All other illegal aliens may be detained at the discretion of the Secretary of the Department of Homeland Security (DHS), and should be, to ensure that they appear for their removal proceedings. But the Biden Regime has decided to ignore both the law and good judgment as part of its campaign to Elect A New People and displace the Historic American nation. If an alien is not detained, that alien never appears for a deportation hearing and will be around for the next amnesty. So, while openly encouraging and releasing the invaders currently flooding over our border with Mexico, the Biden Amnesty is also extending to those few illegal aliens who are supposed to be detained until deported.

This is the solution to the deportation problem: you can’t deport any illegal aliens if they are all released into America and you also prohibit ICE from arresting those same illegal aliens. Problem solved, amnesty accomplished.

U.S. Immigration and Customs Enforcement (ICE) is planning to reduce its use of three facilities and to shut down a detention center in Alabama over concerns regarding conditions.

An internal government document obtained by Reuters said ICE will be reducing the number of beds at detention centers in North Carolina and Louisiana, partly due to a reduced number of detainees. The use of a center in Glades County, Florida, will be paused, with the agency citing “persistent and ongoing concerns related to the provision of medical care at the facility,” according to the memo.

“These actions should be seen as part of a larger and ongoing review to ensure our detention facilities are not only safe and secure but represent an appropriate use of government funds,” said an internal email written by ICE acting Director Tae Johnson, according to the The Washington Post.

The move comes just weeks after House Democrats sent a letter to the Biden administration pushing for ICE to suspend detention expansions and conduct a review of all its facilities. Since President Joe Biden took office, there has been more than a 55 percent increase in the number of detainees at ICE facilities.

ICE indicates that it currently has more than 130 operational detention centers for immigrant detainees. Nearly 22,000 immigrants are in custody at these facilities, Reuters added.

And before you get excited about 22,000 illegal aliens in detention, that is down from a high of about 60,000 under the Trump Administration.

The cost will be more than just a destroyed nation, before that is completely accomplished many thousands more Americans will die at the hands of these released illegal aliens in the short term, while the hundreds of thousands will die in the upcoming collapse of the American state in the near future caused by racial conflict and anarchy, all fine with Joe Biden and Tae Johnson.

It will be up to the incoming Republican majority to end the invasion, fund and require detention of all illegal aliens, and impeach Joe Biden and Alexandro Mayorkas.
