"Send Her Back" — Denaturalize And Deport Ilhan Omar

Vicious anti-white bigot and America hater Ilhan Omar is in the news again when supporters of President Trump chanted “Send her back” at a rally. And “Sending her back” is a good idea. Although she’s an American citizen, she can be denaturalized and deported. It’s been done before.

Here is the legal justification for her deportation.

Omar, true name Ilhan Nur Said Elmi, came to the United States as a refugee, admitted as the dependent of an applicant for refugee status, RE-8, as the daughter of Nur Omar Mohamed, true name Nur Said Elmi Mohamed, admitted as the primary beneficiary of a petition for admission as a refugee, RE-6.

A refugee is defined as an alien who is located outside of the United States, is of special humanitarian concern to the United States, demonstrates that they were persecuted or fear persecution due to race, religion, nationality, political opinion, or membership in a particular social group, is not firmly resettled in another country, and is admissible to the United States.

The most important part of this is that the alien is of some sort of humanitarian concern of the United States. That is because just not anyone suffering persecution may apply to be a refugee to the United States. There is no right to be a refugee. It is an act of discretion on the part of the United States. Sadly, Somalis have been, for some unknown reasons, of special interest of the United States government under both Democrat and Republican administrations, especially Bill Clinton and George Bush. For example, we admit Somalis as refugees, but not Palestinians, despite both being officially determined by the United Nations as refugees. Similarly, the United States considers Palestinians, even if living in refugee camps, as firmly resettled, but do not consider Somalis living in Kenyan refugee camps for four years, like Nur Omar Mohamed and his children, to have been firmly resettled. Not that I would want either group in the United States.

Importantly, no alien may be admitted to the United States as a refugee if that alien was involved in any persecution of any other person. Additionally, certain other exclusions apply, such as terrorism or other national security matters. For our case of Nur Omar Mohamed and his children, including the repellent Ilhan Omar, this includes membership in a totalitarian political party, the Somali Revolutionary Socialist Party, closely affiliated with the Communist Party of the Soviet Union and the Soviet state. Why is that important? Because Nur Omar Mohamed was an official of a totalitarian government involved in human rights violations. Mohamed was a government employee of the Siad Barre Communist regime in Somalia, the very definition of a human rights violator, and therefore barred from admission as a refugee.

Nur [Omar Mohamed], Representative Omar’s father, appears to have been a party propagandist under the dictator and was responsible for ‘ideological’ aspects of the Red-Green revolution. (He worked for the Marxist/Stalinist regime under dictator Baare as a teacher of teachers.) This could have included providing the ideological/political justification for the massacres of the late eighties.

As a member of the Barre regime and Somali Revolutionary Socialist Party, Nur Omar Mohamed was again ineligible for admission as a refugee.

Consequently, any dependents, such as Ilhan Omar, were similarly ineligible for admission as the dependent of a refugee applicant, her father. Now Ilhan Omar could have applied on her own, at least theoretically, but that is irrelevant as she entered as a dependent of an inadmissible alien.

So, now that we know Ilhan Omar was illegally admitted as a dependent of a refugee, what is the next step? Omar has since been naturalized, as has her father. The process is called denaturalization.

This is the legal process managed by U.S. Citizenship and Immigration Services (USCIS) that revokes the citizenship of naturalized Americans. I have consulted with a senior official at USCIS about the case and there are no legal impediments to the case. The only impediments are, sadly, political, the will to take the case to its conclusion, which after USCIS has determined a naturalized citizen was illegally naturalized, e.g. based on a fraudulent adjustment from RE-8 to Legal Permanent Resident (LPR) since the initial admission as RE-8 was fraudulent.

James Fulford reported on a recent case of this in May of last year. The Dallas News had headlined it In a move once reserved for Nazis, sex offender from Grand Prairie loses citizenship and gets deported, but it now reads In rare legal decision, sex offender from Grand Prairie loses citizenship and gets deported, May 25, 2018. ("Correction: The headline has been updated to omit the incorrect statement that loss of citizenship was once reserved for Nazis.")

They failed to correct the basic flaw in the headline: pedophile Emmanuel Olugbenga Omopariola was not from Grand Prairie, he was Nigerian.

As Fulford wrote at the time

The point about "a move once reserved for Nazis" is that the US government pursued a policy of denaturalizing anyone who could be shown to have lied on his immigration papers. Ann Coulter, discussing the number of undeported radical Muslims, et cetera wrote last year that

To this day, we have a whole office at the Department of Justice dedicated to finding and deporting Nazis even without proof they personally committed crimes against Jews.

But they could only do this because the Government always asks new citizens to swear that they weren’t Nazis before naturalizing them. In Afroyim v. Rusk in 1967, the Supremes ruled that you can’t take away anyone’s citizenship for something they do after they're naturalized, only for fraud during the naturalization process — which this Nigerian seems to have committed.

And this Somalian Congresswoman.

USCIS needs to issue an official finding, notify Ilhan Omar, as well as her father, that USCIS has determined that their naturalization was fraudulently obtained, after which they can appeal the decision to either the Administrative Appeals Office (AAO) or to the Executive Office for Immigration Review (EOIR), the immigration courts. After the review by the EOIR, Ilhan Omar can appeal to the courts. Obviously this will take some time, but once appeals are over, Ilhan Omar and her father would be deported back to Somalia.

Now, one might claim that she cannot be deported to the country which she fled, the failed State of Somalia. Many Somalis in deportation proceedings claim they cannot be deported to a nation that doesn’t have a functional government or where they will be in danger. That is where one would be wrong. While Somalia is a land of mostly anarchy, most Somalis outside Somalia routinely travel there, including so-called refugees, Ilhan Omar included.

Representative-elect Ilhan Omar is spending time in Mogadishu, Somalia with her father and cultural husband Ahmed Hirsi before she is officially sworn in as State Representative for House District 60B.

Omar originally traveled to her birthplace for the elections occurring in Somalia. However, according to German news outlet Deutsche Welle, the election has once again been delayed until January 2017.

Somalia’s President Hassan Sheikh invited Omar to meet with him before the elections took place. Accompanied by her husband, Omar spoke about the advances in women’s rights seen in Somalia.

Which brings us to the most obvious problem with Ilhan Omar’s refugee status: it was all a lie in the first place. There was never any fear of persecution. It was all an elaborate scheme to come to the United States. How else would she lived such a luxurious life in Nairobi, not in a refugee camp, but in a country where her father worked and maintained a good life.

Time for Ken Cuccinelli to take action against Ilhan Omar and her father. Cuccinelli has talked the talk on immigration enforcement, no time for him to walk the walk.
