The Judiciary Has Gone Mad. What Is The Solution?

The sight of the 5th U.S. Circuit Court of Appeals reinstating a stay on the Texan immigration law hours after the Supreme Court had lifted it [Battle over Texas’ controversial immigration law continues with federal appeals court hearing Wednesday, Devan Cole, Tierney Sneed and Hannah Rabinowitz, CNN, March 20, 2024] further firms up a long-standing opinion. This is that the American Judiciary is an asylum for power-crazy lunatics, who are, however, all united in the view that the will of the people as expressed by their elected Legislatures does not count. And that the Constitution says what they say it says. (The panel split 2-1 in favor reinstatement, a George W. Bush appointee and a Biden appointee being in favor, a Trump appointee being opposed.)

During Trump’s Presidency the Judiciary made a determined effort to seize control of immigration policy to prevent Trump honoring his mandate.

Emboldened by getting away with the January 6 atrocities and the Trump litigation, a second Trump term will see much worse behavior.
