From the Volokh Conspiracy, now unpaywalled at Reason.com, two very short items extracted from a roundup:
- There’s no need to reconsider the conviction of a white supremacist sentenced to die for his role in the murder of a black man, says the Fifth Circuit. The victim, who was chained to the back of a pickup truck and dragged to his death, is memorialized in both state and federal hate crimes legislation.
- Responding to a call about a dispute between neighbors in Milwaukee, very bad police officer sexually assaults the caller, is subsequently convicted and sentenced to 24 years in prison. Seventh Circuit: But his very bad lawyers provided ineffective counsel, so try him again.[Emphases added.]
Short Circuit: A roundup of recent federal court decisions,by John K. Ross, February 26, 2018
My reaction to the first one was "Is that guy still alive?" The crime was committed while George W. Bush was Governor of Texas, and doesn’t involve any white nationalist intellectuals of the kind that the MSM likes to call white supremacists — it was committed by two ex-convicts who had learned not to like blacks in prison. [Becoming A Devil, uexpress.com ,By Joseph Sobran, March 22, 1999] It was a horrifying murder, and the guy who did it deserved to be executed some time in the 20th century. The crime was committed on June 7, 1998, its 20th anniversary is approaching, and his continued existence is a miscarriage of justice. But my point in linking that case with the one below it is that he and his victim are identified by race.
What about the "very bad police officer" and his victim — what race are they? Well, according to the 7th Circuit [PDF] the officer is Ladmarald Cates, pictured above. He’s black. The victim is named in the court decision, but I prefer not reprint her name. She’s a black young woman who was 19 at the time of the attack, and no more than five feet tall. After assaulting her, Cates arrested her and charged her with assaulting him for resisting his attack. See She Dialed 911. The Cop Who Came to Help Raped Her, by Michael Daly, Daily Beast, January 29, 2012.
The Daily Beast sees it as a story of unaccountable police officer who victimized an inner city single mom:
As the case headed for trial, Gina Barton of the Milwaukee Journal Sentinel reported that Cates had been investigated for illegal behavior on five previous occasions, three of them involving sexual misconduct. Two of those were with prisoners. The third was with a 16 year-old and that case had been referred to the Milwaukee district attorney’s office, which declined to prosecute. The priors came as no surprise to the 19-year-old who was now accusing him of raping her while he somehow remained employed as a cop.
I see it as a horrifying example of Affirmative Action in police hiring — in some ways worse than what happened to Justine Damond, who was shot to death by a Somali Affirmative Action hire when she called 911.
But the idea that citizens should surrender their guns and allow the police to protect them looks less and less appealing.
