The communists who run The New York Times, want to see VDARE.com in the Gulag.
Because we dared to sue The Times for calling Editor Peter Brimelow an “open white nationalist” — a judge found that smear was indeed actionable although she claimed the NYT’s subsequent stealth-edit withdrawal undid the damage — the Times filed an anti-SLAPP case against us for daring to exercise our constitutional right to petition the government, claiming a new law in New York State allowed them to do so.
SLAPP stands for "Strategic Lawsuit Against Public Participation". New York Governor Andrew Cuomo said the expanded state law would protect the First Amendment by preventing wealthy entities from using the court to strong-arm their opponents with frivolous law suits. Of course, this is exactly what the Times is doing
Thus, The New York Times launched their first-ever anti-SLAPP case, which was proudly touted as a vital undertaking in protecting itself from defamation claims.
But, in a great victory VDARE.com, the Times’ lawsuit was dismissed due to the fact the newly enacted New York State law was not passed until after our libel action was filed.
This may not be the end of the story. The New York Times may appeal. It will have the backing of the Political Establishment. It’s not impossible that a judge could rule the law applies retroactively.
But we are striking back with our own anti-SLAPP demand.
